F.A.Q.

The Brittany Place Homeowners Association, Inc. is a Nonprofit Corporation formed under Alabama Business and Nonprofit Entities Code, Alabama Code, Title 10A, Chapter 3, the “Alabama Nonprofit Corporation Law.” Membership is restricted to the owners of real property described by those certain plats which are filed in the office of the Judge of Probate of Elmore County, Alabama, in Plat Book 14, Page 95. WHAT ARE OUR COVENANTS?

The Brittany Place Homeowners Association Covenants are an agreement between the homeowner and the Association that each will abide by a specific set of standards. By doing so, the attractiveness and overall quality of life in the neighborhood is maintained; and the values of our properties can be preserved over time. See the Covenants at this link.    

WHAT ARE OUR BY-LAWS?

The By-Laws are the guidelines for the operation of the non-profit corporation. The By-Laws define the duties of the various offices of the Board of Directors, the terms of the Directors, the membership's voting rights, required meetings and notices of meetings, and the principal office of the Association, as well as other specific items that are necessary to run the Association as a business. The Board of Directors (Board) is comprised of members who volunteer their time to the Association in an advisory capacity. The Board conducts business according to an established set of rules known as By-Laws. The Association Board administers, enforces and defends the covenants, restrictions and agreements to preserve the architectural and general appearance of the properties and common area within Brittany Place. Funding for this purpose is obtained from annual dues paid by the property owners.

If you own property in Brittany Place, you are a member. Owning property automatically, as well as legally, makes you a member of the Association. In order to be a member in good standing (eligible to vote), you must pay your annual Association dues.

Yes. Failure to do so may result in fines and has potential legal implications.

The Board has five members. Officers serve three year terms, with terms staggered to maintain experience. This is how we are currently configured:

  • The President presides over the meetings of the Board of Directors and of the Members, and is the chief executive officer of the Association.

  • The Vice President shall, in the absence or disability of the President, perform the duties and exercise the power of the President.

  • The Secretary is responsible for the minutes of all meetings of the Board of Directors and of the Members and the minute books and records wherein resolutions enacted at such meetings shall be recorded. The Secretary shall, in general, perform the duties incident to the office of Secretary with respect to record keeping and attestation of the official acts of the Board of Directors.

  • The Treasurer supervises the financial records and books of account.

  • The Director advises the Board.

You must pay your annual dues on time and comply with certain requirements set forth in the Covenants and By-Laws. The owners of each property are required to keep their yards in a neat and clean manner.

WHAT ARE MY ANNUAL DUES?

The Annual Dues, also known as “Regular Assessment,” is the periodic amount due from each homeowner to cover the operating expenses of the common area and provide for reserve funds for replacement of common facilities in future years. Our Regular Assessment is due and payable no later than January 31st. In 2021; our Annual Dues are $200.

Yes. The By-Laws state, “All present and future owners, mortgagees, lessees and occupants of the Lots in Brittany Place Subdivision ... are subject to these Bylaws, the Rules and Regulations.”


WILL MY ANNUAL DUES INCREASE?

The Annual Dues pay for the following (percentages from 2022 Budget):

  • Landscaping of the common areas, including mowing grass, trees and shrubs (43%);

  • Maintenance and repair of our common areas (13%);

  • Liability Insurance for the common areas (12%);

  • Business expenses including taxes, postage, legal fees, etc. for the Association (6%);

  • Utilities (water, power) for the common areas (24%);

  • Other Expenses (1%); and

  • Savings for special projects and emergencies (1%).

Late payments will result in a late charge as dues are due in January. In addition, the Covenants allow the Association to charge late charges and interest and proceed with a lien on your property, or foreclosure proceeding for nonpayment of dues.

The purpose of the Architectural Review Committee (ARC) is to examine and approve or disapprove all initial and subsequent plans, including site plans, for construction of improvements on the Lots within this Subdivision, in accordance with the Covenants. It consists of not less than 3 nor more than 7 members of the Association.

Any change or additions to the exterior of your home or to the exterior of your property (house, landscaping, fencing, storage buildings, gardens, etc.) must be reviewed and approved by the Architectural Review Committee (ARC). We conduct periodic neighborhood property inspections to maintain that every homeowner is abiding by the Homeowners Association Covenants. To maintain the uniform look of the community and preserve drainage easements, all additions of garages/outbuildings, fences or exterior decor of the homes are subject to the approval of the Homeowners Association. Every submission of plans for approval will be approved within 21 days after the written plans are received. You can find forms required for ARC approval at this link.
